WAIVER OF LIABILITY AND RELEASE
This Waiver of Liability and Release Agreement (“Agreement”) is entered into by the participant (“Participant”) and Pardy Central and Related Holdings Ltd. (collectively referred to as the “Company”). By using the facilities or participating in events, activities, or services provided by Pardy Central, Participant acknowledges and agrees to the following terms and conditions:
1. Assumption of Risk
The Participant acknowledges and understands that the activities at Pardy Central, including but not limited to the use of event spaces, game rooms, and equipment, carry inherent risks, including physical injury, property damage, and other potential hazards. The Participant voluntarily assumes all such risks, both known and unknown, regardless of their cause.
2. Release of Liability
The Participant, on behalf of themselves, their heirs, assigns, and personal representatives, hereby fully and forever releases, waives, discharges, and agrees not to hold responsible Pardy Central, Related Holdings Ltd., their owners, employees, contractors, agents, or representatives, for any injuries, accidents, illnesses, loss, or damage to personal property, including but not limited to those arising from negligence, strict liability, or otherwise.
3. Compliance with Rules
The Participant agrees to comply with all posted safety rules and instructions provided by Pardy Central staff. Failure to comply may result in the immediate termination of the Participant’s use of the facilities without refund or recourse. This Agreement shall be governed by and construed in accordance with the laws of the Province of Newfoundland and Labrador.
4. Photographic Release
The Participant grants Pardy Central the right to use any photographs, videos, or other media taken during activities for promotional purposes, without compensation or further permission.
5. Acknowledgment of Understanding
By proceeding to use Pardy Central’s facilities, the Participant acknowledges that they have read this Waiver of Liability and Release, fully understand its terms, and voluntarily agree to its conditions.
By booking or participating in activities at Pardy Central, you acknowledge that you have read and agreed to this Waiver of Liability and Release.
